Details are as follows:
All provinces, autonomous regions, municipalities directly under the Central Government, the Development and Reform Commission of the Xinjiang Production and Construction Corps, the Department of Science and Technology (Committee), the Commission of Industry and Information Technology (Department), the Department of Ecology and Environment, the Bureau of Banking and Insurance Regulatory Bureau, and the Federation of Industry and Commerce: Private energy-saving and environmental protection enterprises are an important force in winning the battle against pollution prevention and control, and play an important role in protecting the ecological environment and building a beautiful China. In order to thoroughly implement the spirit of General Secretary Xi Jinping’s important speech at the private enterprise symposium, implement the "Opinions of the Central Committee of the Communist Party of China and the State Council on Creating a Better Development Environment and Supporting the Reform and Development of Private Enterprises", and coordinate the promotion of epidemic prevention and control and economic and social development, we hereby put forward the following opinions on further optimizing the market business environment in the field of energy conservation and environmental protection, ensuring that private enterprises participate in fair and just competition, and promoting the healthy development of private energy conservation and environmental protection enterprises:
1. Create a fair and open market environment
(1) Further open up key industry markets. In key industries and fields such as petroleum, chemical industry, electricity, and natural gas, we will further introduce market competition mechanisms, liberalize competitive businesses for energy conservation and environmental protection, and actively promote contract energy management and third-party governance of environmental pollution. When promoting the construction of environmental infrastructure such as sewage and garbage, third-party environmental pollution control in parks, collection, treatment and disposal of medical waste and hazardous waste, and the construction of a comprehensive utilization base for bulk solid waste, local governments should be fully open and treated equally, and ensure equal rights, equal opportunities and equal rules. State-owned enterprises and private energy-saving and environmental protection enterprises are encouraged to establish mixed-ownership companies, give full play to their respective advantages, and cooperate in carrying out related businesses. (2) Continue to improve the bidding mechanism. Advocate the principle of quality-first bid evaluation, encourage moderate increase in the weight of technical bids, and strictly prevent vicious low-price competition. Restrictive regulations that affect the access of private enterprises shall not be set in bidding activities, enterprise scale thresholds that are not related to energy-saving and environmental protection business capabilities shall not be set, and performance thresholds that significantly exceed project requirements shall not be set. Local governments shall not seek competitive advantages for specific enterprises in bidding by signing strategic cooperation agreements or other means; they shall not set industry access and qualification standards linked to the nature of the enterprise. (3) Actively fulfill all commitments to the company. All localities should pay attention to the promises and actively fulfill the policy commitments made in accordance with the law. They should not blindly promise preferential conditions to enterprises. Continue to deepen the work of clearing the accounts of private enterprises, establish a work log, and make payments item by item through measures such as situation consultation, problem supervision, supervision and inspection, and follow-up evaluation, and ensure that no new arrears are added. Further promote local and large state-owned enterprises to perform contracts concluded with private energy-saving and environmental protection enterprises in accordance with the law, and pay accounts in a timely manner strictly in accordance with the contract agreement. Do not extend the payment period in the form of acceptance bills or other forms in violation of the wishes of private enterprises or in the form of acceptance bills outside the agreed payment methods. (4) Support participation in the construction of projects to make up for shortcomings and strengthen weaknesses. All localities should address the shortcomings and weaknesses of environmental infrastructure exposed in the response to the new crown epidemic, and actively support private energy-saving and environmental protection enterprises to participate in the construction of medical waste treatment and disposal, sewage and garbage treatment projects, and provide strong guarantees for normalized epidemic prevention and control.
2. Improve stable and inclusive industrial support policies
(5) Encourage participation in the construction of major energy conservation and environmental protection projects. Actively support private enterprises to participate in the battle against air, water and soil pollution prevention and control, guide private enterprises to participate in the construction of environmental infrastructure such as sewage and garbage, collection, treatment and disposal of hazardous waste, treatment and disposal of urban and rural black and odorous water bodies, green circulation transformation of industrial parks, clean production demonstration in key industries, desalination and comprehensive utilization of seawater (bitter and salty water), sewage resource utilization, as well as the construction of major ecological and environmental protection projects such as tailings pond pollution prevention and control projects in the Yangtze River Economic Belt, chemical industry and other industrial park pollution control projects. Development and reform departments at all levels must treat enterprises of all ownership equally and fairly in the application and review of special projects for ecological civilization construction, special bonds for local governments, special treasury bonds and other projects within the central budget. They shall not restrict the application of private enterprises in violation of regulations, and shall not attach additional conditions and requirements. (VI) Implement the current tax preferential policies. Implement tax on corporate income tax for environmental protection and energy conservation and water conservation projects, corporate income tax and value-added tax for comprehensive resource utilization, corporate income tax for special equipment for energy conservation and water conservation and environmental protection, as well as contract energy management and third-party pollution control, and continue to implement convenient tax preferential processing methods in accordance with regulations to facilitate enterprises to enjoy tax preferential treatment. (7) Increase support for green finance. Financial institutions are encouraged to include environmental, social and governance requirements into their business processes, improve the professional service level of green finance for private energy-saving and environmentally friendly enterprises, and vigorously develop green financing. Actively develop green credit, strengthen information communication on major national energy-saving and environmental protection projects, and actively increase financing support for projects that meet the conditions. Support qualified private energy-saving and environmentally friendly enterprises to issue green bonds, unify domestic green bond definition standards, and issue a catalog of green bond support projects consistent with the "Green Industry Guidance Catalog (2019 Edition)". Expand the credit-enhancing methods of energy-saving and environmental protection industries, and actively explore the inclusion of energy use rights, carbon emission rights, pollution emission rights, future income rights for contract energy management, and franchise charging rights in the scope of financing pledge guarantees. Private energy-saving and environmental protection enterprises should adhere to the principle of prudent operation and strictly prevent blindly increasing the leverage ratio. In response to the problems in the capital chain of private energy-saving and environmental protection enterprises, local relevant departments have built exchange platforms on the premise of compliance with the law and regulations to promote asset management companies, investment funds, state-owned capital, etc. to actively participate in the relief of private energy-saving and environmental protection enterprises, and reasonably resolve stock pledge risks. All localities should actively provide assistance to private enterprises with core advanced technologies, long-term development prospects but temporary business difficulties in accordance with the principle of compliance with the law and regulations to help overcome difficulties.
3. Promote the improvement of corporate business level
(8) Improve green technology innovation capabilities. Increase support for green technology innovation in private enterprises and support private enterprises to independently or jointly undertake green technology research and development projects supported by major national science and technology projects and national key R&D plans. In the mixed ownership reform, if no reward, remuneration method and amount are stipulated or agreed with scientific researchers, if the inventor or R&D team of the enterprise transforms green technology innovation achievements in their positions through technology transfer, licensing or investment, rewards and remuneration will be given in accordance with the relevant provisions of the "Law of the People's Republic of China to Promote the Transformation of Scientific and Technological Achievements". Give full play to the role of the National Science and Technology Achievement Transformation Guidance Fund, select a group of key environmental protection technology innovation achievements of private enterprises to support transformation and application, and guide various types of angel investment, venture capital funds, local venture capital funds, etc. to support the innovation and transformation of key technologies of private energy-saving and environmental protection enterprises. Support private energy-saving and environmental protection enterprises to take the lead or participate in the construction of a national technology innovation center in the field of green technology. (9) Promote business model innovation. Encourage private energy-saving and environmental protection enterprises to further innovate contract energy management service models, adopt new business models such as energy management, energy conservation guarantee, and financial leasing based on the characteristics of energy-using units, and promote service content from a single device to processEnergy-saving transformation, regional energy efficiency improvement and expansion. Focusing on enterprises and parks in industries such as steel, metallurgy, building materials, electroplating, chemical industry, printing and dyeing, private enterprises will support third-party control of environmental pollution. Actively implement the payment mechanism based on efficiency, guided by environmental governance effects, and promote the improvement of service levels of environmental protection enterprises. Actively support private enterprises to carry out comprehensive environmental governance and custody services and participate in innovation in ecological environment-oriented development models. (10) Urge enterprises to operate in accordance with the law and regulations. Relevant departments should urge private enterprises in the field of energy conservation and environmental protection to vigorously carry forward the excellent entrepreneurial spirit of abiding by laws and regulations, focusing on quality, pursuing excellence, being honest and abiding by contracts, fulfilling responsibilities, being brave to take responsibility, and serving the society, build a solid bottom line of law-abiding and compliant operations, promote enterprises to improve internal incentive and constraint mechanisms, be brave to undertake urgent, difficult and dangerous tasks such as epidemic prevention and control, disaster relief, actively fulfill social responsibilities, and enhance the social image of enterprises. Legal responsibility will be pursued in accordance with the law for illegal and irregular issues of energy-saving and environmental protection enterprises.
4. Smooth information communication and feedback mechanism
(11) Strengthen information communication. Relevant departments should adopt various forms to understand the demands of private energy-saving and environmental protection enterprises, and open up channels for enterprise opinions and demands. Major policies should be issued to listen to the opinions of relevant stakeholders, and a reasonable buffer period should be left for policy implementation and standard adjustment without sudden brakes. Give full play to the role of industry associations and chambers of commerce, support relevant social organizations to strengthen industry self-discipline, promote information communication, reflect corporate demands, and study major policies. Development and reform and other relevant departments at all levels should strengthen communication and contact with industry associations, chambers of commerce and enterprises, timely understand the potential and potential problems of the energy-saving and environmental protection industry, and build a friendly and clean government-business relationship. (12) Create a good public opinion atmosphere. All localities should strengthen the publicity of energy-saving and environmental protection industry policies, comprehensively publicize the national policies on price, finance, taxation, investment, industry, etc. that support the development of energy-saving and environmental protection industries, help enterprises fully understand policies, make good use of policies, and make full use of policies, and boost the confidence of private energy-saving and environmental protection enterprises. We must strengthen public opinion guidance, actively publicize the advanced technologies, advanced deeds and advanced figures of private energy-saving and environmental protection enterprises, treat private enterprises and entrepreneurs equally in various selection and commendation activities, and create a good atmosphere for the development of private energy-saving and environmental protection enterprises.
